Intellectual Property Rights

All Intellectual Property Rights arising out of or in connection with the Website, including but not limited to any text, graphics or code are owned by the Department.

The Department grants a User permission to copy electronically and print hard copy portions of the Website’s content solely in connection with BMBK Activities

The Department grants a User a limited, revocable, royalty-free license to download or print portions of the material from the different areas of the Website solely for the intended purpose as relevant in connection with the User’s Activity. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this Website is strictly prohibited, unless approved in writing by either BMBK or the Department.  A User is not authorised to make any change or delete any proprietary information content from materials downloaded from the Website.

Trademarks

A User agrees that the Department owns all rights, titles, and interest in and to the intellectual property contained or referred to in the Website, including, without limitation, all trademarks and logos, service marks and official names of BMBK and the Department used in the Website.

Warranty Disclaimer

DCT and BMBK give no representations or warranties, express, implied, or statutory, concerning the Website and content provided in it including, without limitation, any representations and warranties concerning its accuracy or use for a particular purpose, and the User may not place any reliance on its accuracy or use for a particular purpose.  The Department and BMBK do not represent or warrant (i) that the functions contained in the Website will be uninterrupted or error-free; (ii) that any defects of the Website will be corrected; or (iii) that this Website or the server that makes the Website available are free of viruses or other harmful components. The Department and BMBK do not make any representations or warrantees regarding the use of the materials in this Website or their accuracy, adequacy, use for a particular purpose, or otherwise.

Limitation of Liability

The Department and BMBK will have no liability to any User of the Website for any loss or damage, including without limitation, indirect or consequential loss or damages arising out of or in connection with these Terms, and   the use of and content contained in the Website.

Information Errors

If BMBK lists any services or provides any information to a requestor or User that is incomplete or inaccurate, including without limitation, in relation to BMBK space or rent, or provides Users with incorrect information containing errors, BMBK reserves the right to refuse to provide or cancel proceeding with the provision of any service(s) and will be under no obligation to refund a User any amount as a result of any services not being provided to a User.

Notice

BMBK may notify the Users by means of e-mail, a general notice on the Website, or by any other method BMBK deems appropriate.

Amendment of the Terms

The Department in its absolute discretion reserves the right to amend these Terms at any time and from time to time. All amendments will be binding on the Users from the date of the amendment.

Term

These Terms are applicable to all Users accessing the Website and/or completing the Community Programme Registration Form or any Activity with BMBK.

Use of Site

Harassment in any manner or form on the Website, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including any affiliate of the Department or BMBK including, without limitation, any of their employees, hosts, or representatives, other members or visitors of either of them on the Website is prohibited. Users cannot  upload, distribute, or otherwise tarnish the image or reputation of the Department or BMBK by publishing through the Website or otherwise any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or is otherwise objectionable and which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law. Users agree not to upload commercial content on the Website or use the Website to solicit others to join or become members of any other commercial/non-commercial online service or other organisation.

Participation Disclaimer

The Department and BMBK are not responsible for reviewing any communication or material posted to or created by Users accessing the Website and are not liable for the content of these communications and materials. Users acknowledge that by having the ability to view and distribute user-generated content on the Website, the Department and BMBK are merely acting as a passive conduit for their distribution and have no obligation or liability relating to any contents arising out of or in connection with the Website or any activities related to BMBK. The Department and BMBK reserve the right to block or remove any communications or materials required by the Website and uploaded by the Users that either of them determines in their absolute discretion to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark; other Intellectual Property Right of another or (d) offensive, irrelevant to the Department’s and BMBK’s respective Activities, inappropriate or otherwise unacceptable to the Department and BMBK.

Indemnification

A User agrees  fully to indemnify, defend, and hold harmless on a continuing basis the Department and BMKB and their respective officers, including, without limitation, directors, employees, agents, licensors, contractors, service providers and suppliers, from and against all losses, expenses, damages and costs arising out of or in connection with the use and misuse by a User of the Website and its content including, without limitation,  reasonable attorney fees, resulting from any violation of these Terms or any activity related to a User’s account (including, without limitation,  fraudulent, negligent or wrongful acts and omissions) by the User or any other person accessing the Website using the User’s Internet Account.

Third-Party Links

Users agree that the Website may contain links or pointers, including, without limitation, the Department’s website, which are operated by third parties and governed by different terms and conditions, and privacy policies applicable to all Users. BMBK and the Department have no control over these linked sites, all of which have separate privacy and data collection practices, independent of BMBK and the Department.

Users accessing these linked sites do so at their own risk and responsibility and agree that BMBK and the Department have no liability to the Users for these linked sites.

Governing Law & Dispute Resolution

These Terms are governed by and will be construed in accordance with the laws of the Emirate of Abu Dhabi. If a dispute arises out of or in connection with these Terms, the courts of the Emirate of Abu Dhabi will have the exclusive jurisdiction to resolve the dispute.

Prevailing language

In the event of a conflict or inconsistency between the Arabic and English versions of these terms, the English language will prevail.
